COMPENSI CTU, IL TAR LAZIO RIAPRE IL DOSSIER SULLE TARIFFE. IL CNDCEC: NECESSARIO ADEGUARLE


Nuovo impulso alla revisione dei compensi dei consulenti tecnici d?"ufficio e degli altri ausiliari del magistrato.  Il TAR Lazio, con la sentenza n. 14327/2026, pubblicata il 19 agosto, ha ordinato al Ministero della Giustizia e al MEF di pronunciarsi entro 120 giorni sulla richiesta di aggiornamento delle tariffe, rimaste sostanzialmente ferme ai valori del D.M. 30 maggio 2002. La decisione è stata accolta con favore dal Consiglio Nazionale dei Commercialisti, che da tempo sostiene la necessità di adeguare gli importi all?"evoluzione degli incarichi e dei costi sostenuti dai professionisti. Il CNDCEC sottolinea come il tema non riguardi soltanto la tutela economica dei CTU, ma anche la necessità di garantire al sistema giudiziario prestazioni specialistiche adeguatamente valorizzate. Il TAR ha imposto alle amministrazioni di procedere, previa acquisizione dei dati e delle certificazioni Istat necessari per l?"aggiornamento. In caso di ulteriore inerzia, è prevista la possibilità di nominare un commissario ad acta. La pronuncia si inserisce nel percorso già segnato dagli interventi della Corte costituzionale, da ultimo con la sentenza n. 179/2025. La proposta dei commercialisti per le nuove tariffe Il CNDCEC evidenzia il proprio impegno nel confronto con il Ministero della Giustizia per la revisione del D.M. 30 maggio 2002. Nell?"ambito dei lavori della Commissione ministeriale incaricata di rideterminare gli onorari degli ausiliari del magistrato, il Consiglio nazionale ha contribuito alla predisposizione di una proposta normativa destinata a sostituire l?"attuale sistema tariffario. Tra le modifiche prospettate figurano la revisione degli onorari a tempo, il superamento di alcuni limiti quantitativi, l?"introduzione di prestazioni oggi non contemplate e il riconoscimento dei costi organizzativi legati a strutture, tecnologie e formazione. Secondo il CNDCEC, la riforma dovrebbe inoltre affrontare le differenze oggi riscontrabili nelle liquidazioni effettuate dai diversi uffici giudiziari. L?"obiettivo è arrivare a criteri più omogenei, riducendo la discrezionalità e rendendo più prevedibile la remunerazione degli incarichi affidati ai consulenti tecnici.
