RISCOSSIONE E NOTIFICA DEGLI ATTI: LA CASSAZIONE FA CHIAREZZA SU CONTESTAZIONI, COPIE E RATEIZZAZIONI


La Suprema Corte stabilisce quando serve la querela di falso per contestare le notifiche e precisa i limiti dell'istanza di rateazione prima dell'esecuzione. Con l?"Ordinanza n. 24002 del 24 luglio 2026 la Corte di Cassazione ha chiarito le regole sulle contestazioni delle notifiche degli atti fiscali e sull'efficacia della rateizzazione del debito. Il caso Una contribuente ha impugnato una comunicazione di iscrizione ipotecaria e un'intimazione di pagamento lamentando la mancata notifica delle cartelle e dell'avviso di accertamento presupposti. A fronte delle fotocopie delle relate di notifica prodotte dall'Ufficio, la debitrice ne ha disconosciuto la conformità, chiedendo l'esibizione degli originali. Ha inoltre eccepito che l'intimazione le era stata notificata prima della decisione sulla sua richiesta di rateizzazione. La decisione della Corte Nel rigettare il ricorso della contribuente, la Sezione Tributaria ha precisato che, per dimostrare l'avvenuta notifica di una cartella di pagamento, non è necessario produrre in giudizio la copia integrale dell'atto, essendo sufficiente l'esibizione della relata o dell'avviso di ricevimento.   In merito alla contestazione delle fotocopie ex art. 2719 c.c., i giudici hanno evidenziato che il disconoscimento deve essere sempre chiaro, specifico e circostanziato; qualora il contribuente intenda contestare l'esistenza stessa del documento originale o la veridicità dell'attestazione, non basta un mero disconoscimento, ma è indispensabile proporre querela di falso.   Infine, con riferimento alla dilazione del debito, la Suprema Corte ha chiarito che l'istanza di rateizzazione blocca l'avvio di nuove azioni esecutive ma non osta alla notifica dell'intimazione di pagamento, poiché quest'ultima ha natura sollecitoria e di avviso, non costituendo un atto esecutivo in senso stretto.
