DICHIARAZIONE INTEGRATIVA: L'EFFICACIA FORMALE NON EVITA IL CONTROLLO DI MERITO SULLA CARTELLA


Dichiarazione IVA, controllo automatizzato e cartella di pagamento: la Cassazione si pronuncia sull?"efficacia dell?"integrativa presentata dopo la comunicazione di irregolarità. Con l?"Ordinanza n. 24863 del 31 agosto 2026 la Corte di Cassazione ha esaminato il caso di una società destinataria di una cartella di pagamento, emessa a seguito del controllo automatizzato sulla dichiarazione IVA 2017, dalla quale risultava un debito di 69.726 euro. La società aveva successivamente presentato una dichiarazione integrativa, prima dell?"emissione della cartella, con la quale aveva modificato i dati della dichiarazione originaria, azzerando il debito IVA. La Corte di Giustizia Tributaria di primo grado aveva accolto il ricorso, mentre il giudice d?"appello aveva confermato la cartella, pur riconoscendo validità ed efficacia all?"integrativa. L'integrativa conserva efficacia, ma non basta da sola La Cassazione ha confermato questa impostazione: la dichiarazione integrativa presentata nei termini di legge mantiene la propria efficacia anche se successiva alla comunicazione di irregolarità. Tuttavia, il contribuente deve dimostrare la correttezza sostanziale dei dati modificati. Nel caso concreto, la documentazione prodotta dalla società non è stata ritenuta sufficiente a giustificare la consistente riduzione delle operazioni imponibili. Inoltre, i dati dello spesometro 2017 risultavano coerenti con la dichiarazione originaria e non con quella integrativa. La valutazione degli elementi probatori effettuata dal giudice di merito è stata ritenuta dalla Suprema Corte adeguatamente motivata.La Corte ha quindi rigettato il ricorso della società, condannandola al pagamento delle spese di lite, liquidate in 5.900 euro per compensi.
