SALUTE E SICUREZZA - RIVALUTAZIONE DELLE SANZIONI - INDICAZIONI OPERATIVE DALL'INL


L'Ispettorato Nazionale del Lavoro (INL), in seguito alla pubblicazione del Decreto direttoriale n. 12 del 6 giugno 2018, recante la rivalutazione delle sanzioni concernenti le violazioni in materia di salute e sicurezza, ha emanato la Lettera-Circolare del 22 giugno 2018, Prot. 0000314, recante le indicazioni operative per il personale ispettivo. L'INL ricorda che il Decreto del Capo dell'Ispettorato Nazionale del Lavoro n. 12 del 6 giugno 2018 ha stabilito che "le ammende previste con riferimento alle contravvenzioni in materia di igiene, salute e sicurezza sul lavoro e le sanzioni amministrative pecuniarie previste dal decreto legislativo 9 aprile 2008, n. 81 nonché da atti aventi forza di legge, sono rivalutate, a decorrere dal 1° luglio 2018, nella misura dell'1,9%". L'incremento dell'1,9% va calcolato sugli importi delle sanzioni attualmente vigenti e, analogamente a quanto previsto nella precedente rivalutazione, si applica esclusivamente alle ammende e alle sanzioni amministrative pecuniarie irrogate per le violazioni commesse successivamente al 1° luglio 2018 e non sono previsti arrotondamenti delle cifre risultanti dal calcolo. Va altresì osservato che l'incremento non si applica alle "somme aggiuntive" di cui all'art. 14 del D.Lgs. vo n. 81/2008, che occorre versare ai fini della revoca del provvedimento di sospensione dell'attività imprenditoriale, le quali non costituiscono propriamente una "sanzione". Alla lettera circolare è allegato un utile quadro riepilogativo delle ammende e delle sanzioni pecuniarie più ricorrenti, con indicazione degli importi rivalutati per effetto del Decreto n. 12/2018.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
