CONCORSI E OPERAZIONI A PREMIO VIETATI: PRONTO IL CODICE TRIBUTO PER IL VERSAMENTO DELLE SANZIONI


In arrivo nuove istruzioni fiscali e modalità operative F24 per la regolarizzazione delle sanzioni in materia di elusione del monopolio statale dei giochi. L'Agenzia delle Entrate, con la Risoluzione n. 33/E del 22 settembre 2026, ha istituito il codice tributo per consentire il versamento, tramite modello "F24 Accise", delle sanzioni amministrative pecuniarie collegate allo svolgimento di concorsi e operazioni a premio vietati. La misura dà seguito alla richiesta formalizzata dall'Agenzia delle Dogane e dei Monopoli (Direzione Giochi) per intercettare i proventi sanzionatori derivanti dalle violazioni in materia di gioco pubblico.    Quadro normativo e perimetro sanzionatorio La disciplina di riferimento è legata all'articolo 12, comma 1, lettera o), del decreto-legge n. 39/2009, che punisce l'effettuazione di manifestazioni a premio vietate con una sanzione amministrativa che va da 50.000 a 500.000 euro. La sanzione è raddoppiata in caso di prosecuzione dell'attività ed è estesa a tutti i soggetti coinvolti nella distribuzione del materiale promozionale.    Come specificato dal comma 1-bis del medesimo articolo, il regime sanzionatorio trova applicazione esclusiva per i concorsi e le operazioni a premio per i quali sia stata accertata la coincidenza con le attività di gioco riservate allo Stato o l'elusione del monopolio statale.    Il nuovo codice tributo e le istruzioni F24 Per consentire il versamento, l'Agenzia ha istituito il seguente codice tributo:    "5518" denominato "Sanzione amministrativa pecuniaria art. 12, comma 1, lett. o), DL 39/2009 – elusione monopolio statale dei giochi in materia di concorsi e operazioni a premio".    In sede di compilazione del modello "F24 Accise", il codice deve essere esposto nella "Sezione Accise/Monopoli e altri versamenti non ammessi in compensazione" in corrispondenza degli "importi a debito versati". I contribuenti dovranno indicare la lettera "M" nel campo "ente" e riportare l'anno di riferimento nel formato "AAAA". Non dovranno invece essere valorizzati i campi relativi a provincia, codice identificativo, rateazione, mese, codice atto e codice ufficio.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
