WHISTLEBLOWING, NUOVE REGOLE PER CONFLITTO DI INTERESSI E ASSENZA DEL RPCT


Il provvedimento dell?"Agenzia delle Entrate disciplina la gestione delle segnalazioni di whistleblowing nei casi in cui il Responsabile della Prevenzione della Corruzione e della Trasparenza (RPCT) si trovi in conflitto di interessi o sia temporaneamente assente. Conflitto di interessi del RPCT Con il Provvedimento del 2 ottobre 2026 l?"Agenzia delle Entrate dà attuazione a quanto previsto dalle Linee guida ANAC n. 1 del 2025, individuando le modalità di sostituzione del RPCT nelle situazioni che potrebbero comprometterne l?"indipendenza nella gestione della segnalazione. In particolare, qualora il RPCT si trovi in una situazione di conflitto di interessi e sia quindi tenuto ad astenersi, viene sostituito dal Direttore Centrale Affari Legali. La stessa procedura si applica quando il RPCT coincida con la persona coinvolta o interessata dalla segnalazione, abbia un interesse personale collegato alla stessa oppure sia la persona segnalante. In tali casi, la segnalazione deve essere inviata tramite servizio postale al Direttore Centrale Affari Legali, in qualità di sostituto del RPCT, utilizzando l?"apposito modulo disponibile sul sito dell?"Agenzia. Il Direttore Centrale Affari Legali sostituisce inoltre il RPCT in caso di assenza imprevista e/o prolungata dal servizio che ne impedisca lo svolgimento delle funzioni. Nell?"esercizio delle funzioni di RPCT, potrà avvalersi del supporto dell?"Ufficio Supporto al RPCT e, ove necessario, delle altre strutture della Direzione Centrale Audit. La scelta, spiega l?"Agenzia nelle motivazioni, è volta a garantire la continuità dell?"azione amministrativa e a individuare una figura dotata delle caratteristiche di autonomia e della competenza specialistica necessarie. Il provvedimento sostituisce il precedente provvedimento prot. n. 7661 del 20 luglio 2023, alla luce delle nuove indicazioni contenute nelle Linee guida ANAC n. 1 del 2025.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
