CPB E SOCIETà TRA PROFESSIONISTI: L?"ACCESSO AL CONCORDATO PASSA DAGLI ISA


Il requisito dell?"applicazione degli ISA e le condizioni di accesso al CPB alla luce dei chiarimenti dell?"Agenzia delle Entrate. L'Agenzia delle Entrate, con la Circolare n. 8/E del 6 ottobre 2026, ha raccolto nell'Allegato 1 una serie di risposte a quesiti sul Concordato preventivo biennale (CPB), anche alla luce delle modifiche normative intervenute. Tra i chiarimenti riproposti figura quello relativo alla possibilità per le società tra professionisti di accedere al regime. L'accesso al CPB e l'applicazione degli ISA Il quesito C5, già oggetto della Faq n. 2 del 17 ottobre 2024, riguarda in particolare le società tra professionisti che, in quanto titolari di reddito d'impresa, chiedono se possano accedere al Concordato preventivo biennale. L'articolo 10 del decreto CPB stabilisce che possono accedere al regime i contribuenti che esercitano attività d'impresa, arti o professioni e che applicano gli indici sintetici di affidabilità fiscale (ISA) previsti dall'articolo 9-bis del Dl n. 50/2017.Il requisito dell'applicazione degli ISA assume quindi rilievo ai fini dell'accesso al CPB.  Sono pertanto esclusi dall'ambito soggettivo del Concordato i soggetti che esercitano un'attività d'impresa o di lavoro autonomo per la quale non risultano approvati gli ISA. L'Agenzia precisa che gli ISA possono essere approvati con riferimento ad attività esercitate in forma d'impresa o di lavoro autonomo, oppure esclusivamente in una delle due forme.Tra le attività per le quali sono previsti ISA esercitabili sia in forma d'impresa sia di lavoro autonomo rientrano, ad esempio, i servizi di progettazione di ingegneria, i servizi di amministrazione di condomini e gestione di beni immobili per conto terzi e i servizi di fisioterapia.Altri ISA, invece, sono approvati esclusivamente per attività esercitate in forma di lavoro autonomo. È il caso, tra gli altri, degli studi notarili, delle attività tecniche svolte dai geometri, degli studi legali e dei servizi forniti da commercialisti, esperti contabili, consulenti del lavoro, revisori contabili e altri soggetti che svolgono attività in materia di amministrazione, contabilità e tributi, quando tali attività producono reddito di lavoro autonomo.Vi sono infine ISA approvati esclusivamente per i contribuenti che esercitano attività d'impresa, come quelli relativi, ad esempio, alle riparazioni meccaniche di autoveicoli, ai saloni di barbiere e parrucchiere, alla ristorazione con somministrazione e all'attività di mediazione immobiliare. Ne consegue che, ai fini dell'accesso al CPB, non è sufficiente considerare la forma societaria o la natura del reddito prodotto: occorre verificare se, per l'attività concretamente esercitata, risulti approvato e applicabile il relativo ISA.
