PRESENTAZIONE ISTANZE DI INTERPELLO DEL GRUPPO IVA: CHIARIMENTI NELLA RISOLUZIONE N. 54/E DELL'AGENZIA ENTRATE


Con la Risoluzione n. 54/E del 10 luglio 2018 l'Agenzia delle Entrate ha fornisce chiarimenti in merito alle modalità di presentazione delle istanze di interpello, finalizzate all'esclusione o all'inclusione di soggetti passivi d'imposta in un gruppo IVA. Le Entrate, in particolare, hanno chiarito che le istanze di interpello finalizzate a superare le presunzioni di esclusione o inclusione possono essere presentate anche nel periodo anteriore alla costituzione di un gruppo IVA. Per la regolare presentazione dell'interpello è richiesta la sottoscrizione sia del rappresentante del Gruppo IVA costituito o del futuro rappresentante del Gruppo IVA costituendo, sia del membro di cui si vuole provare il difetto o il possesso di un requisito di partecipazione. La duplice sottoscrizione, si legge nel documento, è funzionale alla rappresentazione complessiva della rete dei soggetti passivi interessati alla formazione di un Gruppo IVA, che solo il rappresentante può fornire. La presentazione dell'istanza di interpello da parte del futuro rappresentante non obbliga quest'ultimo all'esercizio dell'opzione di costituzione del Gruppo IVA.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
