CONSULENZA GIURIDICA TRIBUTARIA: L'AGENZIA DELLE ENTRATE FISSA LE REGOLE OPERATIVE


Lo Statuto del contribuente ha introdotto l'istituto della consulenza giuridica: le Agenzie fiscali definiscono ora le modalità attuative per professionisti e imprese. La consulenza giuridica tributaria entra in una nuova fase operativa. Con il Provvedimento dell?"8 giugno 2026 l'Agenzia delle Entrate ha definito le regole procedurali per la presentazione, la gestione e la risposta alle istanze previste dall?"articolo 10-octies dello Statuto dei diritti del contribuente.L?"intervento attua le disposizioni introdotte dal decreto legislativo n. 219/2023 e dal decreto attuativo del MEF, completando così il quadro operativo dell?"istituto, pensato per fornire chiarimenti interpretativi su questioni fiscali di interesse generale. Un canale per quesiti interpretativi “collettivi” La consulenza giuridica si distingue dall?"interpello perché non riguarda casi concreti riferiti al singolo contribuente, ma questioni di carattere generale su norme tributarie potenzialmente rilevanti per una platea ampia di soggetti.Possono presentare istanza esclusivamente i soggetti indicati dalla legge, tra cui: associazioni sindacali e di categoria e ordini professionali; enti pubblici territoriali e amministrazioni periferiche dello Stato; amministrazioni centrali ed enti di rilievo nazionale; soggetti non residenti. Le istanze sono presentate alle Direzioni regionali competenti o, nei casi più rilevanti o complessi, alla Divisione Contribuenti dell?"Agenzia delle Entrate. Istanze, istruttoria e modalità di presentazione Il Provvedimento chiarisce che le istanze: sono in forma libera ed esenti da bollo; devono essere sottoscritte dal legale rappresentante; devono contenere una dichiarazione circa l?"assenza di attività di controllo in corso sulla medesima questione. L?"Amministrazione può richiedere integrazioni documentali una sola volta oppure invitare alla regolarizzazione entro termini specifici. In caso di mancata risposta nei termini, l?"istanza può essere considerata rinunciata o improcedibile.È inoltre prevista la possibilità per le Direzioni regionali di rimettere le questioni alla Divisione Contribuenti nei casi di maggiore complessità. Le risposte devono essere rese entro il termine previsto dal decreto attuativo e sono comunque soggette a sospensione dei termini nel periodo compreso tra il 1° e il 31 agosto. Il Provvedimento disciplina anche le ipotesi di sospensione del procedimento in caso di richiesta di pareri ad altre amministrazioni, stabilendo che, in assenza di riscontro entro 60 giorni, l?"istanza può essere dichiarata improcedibile.Le risposte alle istanze ammissibili saranno pubblicate sul sito dell?"Agenzia delle Entrate, secondo criteri già definiti da precedenti provvedimenti. Il Provvedimento completa il quadro attuativo dell?"istituto, definendo in dettaglio uffici competenti, modalità di presentazione delle istanze, regole istruttorie e termini procedurali per la gestione delle richieste di consulenza giuridica.
