DETRAZIONE PER BOX AUTO E PERTINENZE: ESCLUSA SE MANCA IL VINCOLO IN CONCESSIONE EDILIZIA


L?"Agenzia delle Entrate chiarisce i requisiti per la detrazione del 50% per la costruzione di posti auto pertinenziali e il ruolo della documentazione edilizia ai fini dell?"agevolazione. Con Risposta ad interpello n. 118 dell'8 giugno l'Agenzia delle Entrate è intervenuta sul caso di un contribuente che aveva realizzato nel 2025 una struttura in legno su un cortile comune, destinata di fatto a posto auto pertinenziale dell?"abitazione principale. L?"opera era stata regolarmente autorizzata tramite concessione edilizia, nella quale tuttavia non risultava alcun riferimento alla destinazione a parcheggio né al vincolo di pertinenzialità.La struttura risultava inoltre accatastata in categoria C/2 (magazzini e locali di deposito) e dotata di rendita autonoma, pur essendo utilizzata come autorimessa e qualificata dal contribuente come pertinenza dell?"abitazione principale anche ai fini comunali. La posizione dell?"Agenzia Nel richiamare la disciplina dell?"articolo 16-bis del TUIR, l?"Amministrazione finanziaria ha ribadito che la detrazione per la realizzazione di autorimesse o posti auto pertinenziali è ammessa solo se sussistono requisiti stringenti, tra cui la prova del vincolo di pertinenzialità con l?"unità abitativa.Elemento centrale è la concessione edilizia, dalla quale deve risultare espressamente tale vincolo. Nel caso analizzato, tale indicazione risultava assente, circostanza già di per sé ostativa alla fruizione dell?"agevolazione. Inoltre, l?"Agenzia ha evidenziato un ulteriore profilo decisivo: la classificazione catastale dell?"immobile. La struttura, essendo censita come C/2 e non come C/6 (categoria tipica delle autorimesse), non può essere qualificata come posto auto ai fini della detrazione. Alla luce di entrambi gli elementi, mancanza del vincolo di pertinenzialità nella concessione edilizia e inquadramento catastale non coerente, l?"Agenzia delle Entrate ha escluso la possibilità di accedere alla detrazione prevista per la costruzione di autorimesse e posti auto pertinenziali. La risposta conferma quindi l?"orientamento restrittivo in materia, attribuendo rilievo decisivo non solo all?"effettivo utilizzo del bene, ma soprattutto alla qualificazione formale risultante dalla documentazione urbanistica e catastale.
