CONCORDATO PREVENTIVO BIENNALE: NUOVI CHIARIMENTI DELL'AGENZIA DELLE ENTRATE SU ACCONTI E RINNOVO


Con due FAQ pubblicate il 3 giugno 2026, l?"Agenzia delle Entrate interviene su alcuni aspetti applicativi del Concordato Preventivo Biennale (CPB), fornendo chiarimenti in materia di determinazione degli acconti e di applicazione delle maggiorazioni previste in caso di adesione o rinnovo del regime. Acconti e plusvalenze: effetti anche per i contribuenti in CPB Con la prima risposta, l?"Amministrazione finanziaria chiarisce l?"impatto delle novità introdotte dalla legge di bilancio 2026 sul calcolo degli acconti delle imposte sui redditi e dell?"IRAP per i soggetti che hanno aderito al CPB.In particolare, viene precisato che, anche per i contribuenti in concordato, ai fini del metodo storico di determinazione degli acconti per il periodo d?"imposta successivo al 2025, devono essere considerate le modifiche normative che incidono sulla tassazione delle plusvalenze, le quali concorrono integralmente alla formazione del reddito nel periodo di realizzo.Di conseguenza, l?"imposta del periodo precedente deve essere rideterminata tenendo conto dell?"intero ammontare delle plusvalenze realizzate nel 2025, e non della sola quota eventualmente frazionata secondo le precedenti regole. Per chiarire megio l'impatto della modifica normativa l'Agenzia Entrate riporta la casistica di un contribuente che ha aderito al CPB per il biennio 2025-2026 e che utilizza il metodo storico per il calcolo dell?"acconto dovuto per il 2026: Determinazione della base imponibile per il calcolo dell?"acconto 2026 - ante modifica normativa in presenza di un Reddito CPB 2025 pari a 1200 Reddito CPB 2025 = 1.200Rettifiche ex art.16 D.lgs. 13/2024: quota plusvalenza realizzata nel 2025 (1/5 di 500) = 100Reddito CPB dichiarato per il 2025 (base di calcolo per l?"acconto del 2026) = 1.300 (1.200 + 100) Determinazione della base imponibile per il calcolo dell?"acconto 2026 - post modifica normativa Reddito CPB 2025 = 1.200Rettifiche ex art.16 D.lgs. 13/2024: plusvalenza intera realizzata nel 2025 = 500Reddito CPB rideterminato per l?"acconto 2026 = 1.700 (1.200 + 500) Rinnovo del CPB senza maggiorazioni sugli acconti Con la seconda FAQ, l?"Agenzia si sofferma invece sulle maggiorazioni degli acconti previste dall?"articolo 20 del decreto CPB.Viene chiarito che tali maggiorazioni si applicano esclusivamente al primo periodo d?"imposta di adesione al concordato e non sono dovute in caso di rinnovo per il biennio immediatamente successivo.Restano invece applicabili nei casi in cui, dopo un?"interruzione, il contribuente aderisca nuovamente al CPB in un periodo successivo non consecutivo. I chiarimenti forniti si inseriscono nel più ampio assetto normativo del Concordato Preventivo Biennale, delineando criteri applicativi utili per la corretta determinazione degli acconti e per la gestione delle scelte di adesione e rinnovo da parte dei contribuenti e dei loro intermediari.
