IMU, ESENZIONE PER TERRENI EDIFICABILI INUTILIZZABILI: LA CGT MARCHE ESCLUDE IL TRIBUTO IN CASO DI IMPOSSIBILITà GIURIDICA E MATERIALE


La Corte di giustizia tributaria di secondo grado delle Marche, con sentenza n. 168 del 20 febbraio 2026, ha chiarito che l?"IMU e la TASI non sono dovute quando un terreno, pur classificato come edificabile, risulti di fatto inutilizzabile per un accertato impedimento giuridico e materiale. Il caso riguardava un?"area fabbricabile sottoposta a sequestro a seguito del rinvenimento di gravi fenomeni di inquinamento nel sottosuolo emersi durante i lavori di realizzazione delle fondazioni, con conseguente avvio di interventi di bonifica. Nel confermare la decisione di primo grado, i giudici hanno distinto tra il presupposto oggettivo dell?"imposta, rappresentato dall?"edificabilità urbanistica del terreno, e la concreta capacità contributiva del soggetto passivo, che presuppone invece l?"esistenza di un?"effettiva utilità economica del bene.Richiamando i principi espressi dalla Corte costituzionale e dalla Corte di cassazione, la CGT ha affermato che la totale perdita di disponibilità del bene, derivante da un intervento imposto dall?"autorità pubblica e non imputabile al contribuente, esclude la capacità contributiva in quanto non attuale ed effettiva. Secondo i giudici, nel caso esaminato non si è in presenza di una semplice limitazione all?"edificabilità, ma di un impedimento assoluto e giuridicamente imposto per le annualità oggetto di accertamento, tale da escludere il presupposto impositivo.
