LEGGE N. 88/2026: AL VIA LA ROTTAMAZIONE DEGLI ENTI TERRITORIALI


La conversione del DL n. 38/2026 estende la definizione agevolata anche ai debiti di Regioni ed enti locali affidati alla riscossione dal 2000 al 2023. Prevista una procedura articolata con adesioni, comunicazioni e pagamenti fino a 54 rate. Rottamazione-quinquies estesa agli enti territoriali È stata pubblicata nella Gazzetta Ufficiale n. 117 del 22 maggio 2026 la Legge n. 88/2026, di conversione del DL n. 38/2026 (Decreto fiscale), che introduce importanti novità in materia di riscossione.In particolare, viene estesa la Definizione agevolata delle cartelle (Rottamazione-quinquies) anche ai debiti, tributari e non tributari, affidati all?"Agente della riscossione da Regioni ed enti locali nel periodo compreso tra il 1° gennaio 2000 e il dicembre 2023, con esclusione delle somme derivanti da condanne della Corte dei conti. Adesione subordinata alla scelta degli enti locali L?"accesso alla misura non è automatico: ciascun ente territoriale dovrà infatti adottare uno specifico provvedimento, da pubblicare sul proprio sito istituzionale e trasmettere ad Agenzia delle entrate-Riscossione entro il 30 giugno 2026. Le modalità operative saranno definite dall?"Agenzia entro il 15 giugno 2026. Tempi, rate e modalità della definizione La disciplina ricalca quella della Rottamazione-quinquies prevista dalla legge n. 199/2025, con alcune deroghe operative. La domanda di adesione potrà essere presentata tra il 16 settembre e il 31 ottobre 2026, esclusivamente in via telematica. I contribuenti riceveranno entro il 15 settembre 2026 i dati utili per individuare i carichi definibili, mentre l?"importo dovuto sarà comunicato dall?"Agente della riscossione entro il 31 dicembre 2026.Il pagamento potrà avvenire in un?"unica soluzione entro il 31 gennaio 2027 oppure in un massimo di 54 rate bimestrali, con applicazione di interessi al 3% annuo a partire dal 1° febbraio 2027. Sanzioni amministrative: definizione agevolata limitata a interessi e accessori La misura si applica anche alle sanzioni amministrative, comprese quelle relative al Codice della strada, ma la definizione agevolata riguarda esclusivamente gli interessi, gli aggravi e le somme accessorie, restando invece esclusa la quota principale della sanzione.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
