CONCORDATO PREVENTIVO BIENNALE 2026/2027: ARRIVANO TETTI MASSIMI E PROROGA DELLE SCADENZE


Il quadro normativo del Concordato Preventivo Biennale (CPB) per il biennio 2026-2027 si delinea con importanti novità. Tra la conversione in legge del D.L. n. 38/2026 (Decreto Fiscale) e la pubblicazione in Gazzetta Ufficiale del D.M. 11 maggio 2026 , per i contribuenti arrivano tutele, limiti di incremento e più tempo per aderire. La legge di conversione ha introdotto significativi correttivi a favore dei contribuenti. In particolare, vengono fissati dei tetti massimi alla proposta di reddito concordato:   Punteggio ISA tra 6 e 8: la proposta non può eccedere il 30% del reddito dichiarato nel periodo precedente (opportunamente rettificato). Punteggio ISA tra 1 e 6: il limite massimo di incremento è fissato al 35% del reddito del periodo precedente. Viene inoltre stabilito che le maggiorazioni legate all?"iper ammortamento non rilevano nella determinazione del reddito d?"impresa oggetto di concordato, rientrando tra le voci di rettifica. Per dare più respiro a imprese e professionisti, il termine per aderire alla proposta per il biennio 2026-2027 viene ufficialmente differito al 31 ottobre 2026. Il Ministero dell?"Economia ha invece approvato i criteri di calcolo con cui l?"Agenzia Entrate formulerà le proposte. Oltre alla storia reddituale del contribuente, peseranno indicatori ISA specifici come i ricavi per addetto e la durata delle scorte. Il decreto introduce importanti tutele in caso di sospensione dell?"attività economica dovuta a eventi straordinari, prevedendo tagli automatici della proposta del 10%, 20% o 30% in base alla durata del blocco. Vengono infine definite le circostanze eccezionali che determinano la cessazione degli effetti del concordato, come eventi calamitosi, liquidazioni, sospensioni dell?"attività o impatti economici negativi legati alla situazione geopolitica in Medio Oriente (se generano un incremento dei prezzi superiore al 5%).

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
