RISCOSSIONE, IL MEF DEFINISCE I NUOVI FLUSSI INFORMATIVI TRA AGENZIA ENTRATE-RISCOSSIONE ED ENTI CREDITORI


Il Decreto del 29 aprile introduce le nuove modalità telematiche di trasmissione dei dati relativi ai carichi affidati e alle riscossioni effettuate, in attuazione della riforma della riscossione prevista dal D.lgs. n. 110/2024. Il Ministero dell'Economia e delle Finanze, con Decreto del 29 aprile 2026 di prossima pubblicazione in Gazzetta Ufficiale, ha definito le modalità operative con cui l'Agenzia delle entrate-Riscossione dovrà trasmettere agli enti creditori i flussi informativi relativi allo stato delle procedure di riscossione e agli incassi effettuati. Il provvedimento attua quanto previsto dall?"articolo 2, comma 1, lettera d), del D.lgs. n. 110/2024, nell?"ambito della riforma della riscossione. Trasmissione mensile dei dati agli enti creditori Il Decreto prevede che, entro la fine di ogni mese l'?"Agenzia delle entrate-Riscossione trasmetta telematicamente agli enti creditori tutte le informazioni riguardanti: lo stato delle procedure relative alle singole quote ad essa affidate; le riscossioni effettuate nel mese precedente. L?"obiettivo è garantire un aggiornamento costante e strutturato delle informazioni relative ai carichi affidati all?"agente della riscossione. Evidenza separata per i carichi esclusi dal discarico automatico Tra i dati contenuti nei flussi informativi dovranno essere evidenziate separatamente le quote affidate dal 1° gennaio 2025 temporaneamente escluse dal discarico automatico.Si tratta, in particolare, dei carichi per i quali risultano in corso: sospensioni della riscossione; rateazioni; definizioni agevolate; azioni esecutive o cautelari di recupero; procedure concorsuali o accordi previsti dal Codice della crisi d?"impresa e dell?"insolvenza. Rientrano inoltre tra le esclusioni i carichi per i quali sia stata disposta la sospensione della riscossione per almeno diciotto mesi, anche non continuativi, nel quinquennio successivo all?"affidamento. Le modalità tecniche di trasmissione dei flussi, riportate nell?"allegato 1 al Decreto, saranno pubblicate sul sito di Agenzia delle entrate-Riscossione, nell?"area dedicata ai “Servizi agli Enti”.Entro tre mesi dalla pubblicazione del Decreto sarà inoltre reso disponibile un documento tecnico contenente i criteri di valorizzazione dei campi previsti nei tracciati, il dettaglio dei controlli di congruità ed i relativi codici errore.Il documento potrà essere aggiornato in presenza di specifiche esigenze operative o tecniche, con pubblicazione tempestiva delle eventuali modifiche. Regime transitorio La trasmissione dei nuovi flussi informativi partirà dal primo giorno del sesto mese successivo alla pubblicazione del Decreto. Fino a tale data continueranno ad applicarsi le disposizioni previste dal Decreto del 22 ottobre 1999.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
