PROCESSO TRIBUTARIO: LA CONSULTA CONFERMA L?"EFFICACIA DEL GIUDICATO PENALE DI ASSOLUZIONE


Con la Sentenza n. 50 del 13 aprile 2026, la Corte Costituzionale si è pronunciata sull?"art. 21-bis del D.Lgs. n. 74/2000, dichiarando non fondate le questioni di legittimità costituzionale relative all?"efficacia, nel processo tributario, della sentenza penale irrevocabile di assoluzione.La norma riconosce efficacia di giudicato, nel processo tributario, alla sentenza penale irrevocabile di assoluzione pronunciata a seguito di dibattimento con le formule “il fatto non sussiste” o “l?"imputato non lo ha commesso”, rafforzando così la posizione del contribuente anche nel contenzioso fiscale. La Corte ha ritenuto legittima la scelta del legislatore di superare, in questi casi, il tradizionale principio del “doppio binario” tra processo penale e tributario. Tuttavia, ha fornito un?"interpretazione costituzionalmente orientata della disposizione, individuando due rilevanti eccezioni al principio di vincolatività del giudicato penale nel giudizio tributario: nei casi in cui operano presunzioni legali tributarie e l?"assoluzione penale non derivi da un accertamento positivo dell?"inesistenza del fatto, ma dall?"impossibilità di applicare tali presunzioni nel processo penale; quando l?"assoluzione sia fondata esclusivamente sull?"inutilizzabilità delle prove in sede penale, ma le stesse risultino utilizzabili secondo le regole del processo tributario. In tali ipotesi, spetta al giudice tributario valutare autonomamente i fatti e gli elementi probatori, secondo le regole proprie dell?"ordinamento fiscale. La decisione si inserisce nel solco di una progressiva integrazione tra i due ambiti processuali, con l?"obiettivo di garantire maggiore coerenza del sistema e tutela effettiva dei diritti del contribuente, pur preservando margini di autonomia del giudizio tributario in presenza di specifiche condizioni.
