TERZO SETTORE: ESENZIONE DALL?"IMPOSTA DI REGISTRO SOLO PER ETS GIà ISCRITTI AL RUNTS


Chiarimenti sulla portata dell?"art. 82 del Codice del Terzo settore: niente agevolazione per le modifiche statutarie finalizzate all?"iscrizione al RUNTS. L?"esenzione dall?"imposta di registro prevista per alcune modifiche statutarie degli enti del Terzo settore si applica esclusivamente agli enti già iscritti al RUNTS. Restano invece escluse le modifiche adottate da associazioni che intendono iscriversi al Registro.Lo ha ricordato l'Agenzia delle Entrate, in una risposta fornita sulla rivista telematica FiscoOggi. Esenzione imposta di registro: cosa prevede il Codice del Terzo settoreL?"articolo 82, comma 3, del Dlgs n. 117/2017 stabilisce che le modifiche statutarie sono esenti dall?"imposta di registro quando sono effettuate per adeguare gli atti a modifiche o integrazioni normative. La norma si inserisce nel quadro delle agevolazioni fiscali riconosciute agli enti del Terzo settore (ETS), con riferimento anche a operazioni straordinarie come fusioni, scissioni e trasformazioni. Sul punto è intervenuta la Circolare n. 1/2026, che ha precisato l?"ambito soggettivo di applicazione dell?"agevolazione.Per “Terzo settore” si intende infatti l?"insieme degli enti privati: iscritti nel Registro unico nazionale del Terzo settore (RUNTS); privi di scopo di lucro; operanti per finalità civiche, solidaristiche e di utilità sociale; attivi in ambiti di interesse generale attraverso attività volontarie, mutualistiche o di produzione e scambio di beni e servizi. Alla luce di tali chiarimenti, l?"esenzione dall?"imposta di registro non si applica alle modifiche statutarie effettuate da enti non ancora iscritti al RUNTS.In questi casi, infatti, al momento dell?"adozione delle modifiche l?"ente non ha ancora acquisito la qualifica di ente del Terzo settore e, di conseguenza, non può beneficiare del regime agevolato previsto dall?"articolo 82.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
