IRAP DIVIDENDI INFRA-UE O SEE: NUOVO MODELLO PER RIMBORSI E COMPENSAZIONI 2025


Nuove regole per il recupero dell?"IRAP sui dividendi esteri: l?"Agenzia delle Entrate definisce modello, modalità e compensazione con vincolo al contributo straordinario. Con Provvedimento del 22 aprile l'Agenzia Entrate, in recepimento delle indicazioni della Corte di giustizia UE e delle correlate modifiche normative interne, ha approvato il modello di istanza, con relative istruzioni, da utilizzare per richiedere il rimborso o l?"utilizzo in compensazione dell?"eccedenza IRAP riferita ai dividendi infra-UE o SEE (Spazio economico europeo), che hanno concorso alla formazione del valore della produzione netta (articoli 6 e 7 del Dlgs n. 446/1997), in misura eccedente il 5%.Con lo stesso provvedimento l'Agenzia definito le modalità e i termini di presentazione dell?"istanza. Adeguamento alla direttiva “madri-figlie”Le novità derivano dall?"adeguamento alla direttiva “madri-figlie”, a seguito della sentenza del 1° agosto 2025 della Corte di giustizia dell?"Unione europea, e comportano, a partire dal periodo d?"imposta in corso al 31 dicembre 2025, l?"esclusione dal valore della produzione netta e dalla base imponibile IRAP del 95% dei dividendi percepiti da intermediari finanziari e imprese di assicurazione provenienti da società residenti in Stati UE o SEE collaborativi. Rimborsi per i periodi d?"imposta precedenti e compensazione con vincolo al contributo straordinarioPer i periodi d?"imposta precedenti, i contribuenti possono recuperare l?"IRAP versata in eccesso presentando apposita istanza, purché non siano decorsi i termini per il rimborso. In alternativa, è prevista la possibilità di optare per l'utilizzo delle somme rimborsabili in compensazione tramite modello F24; in tal caso, il provvedimento specifica che la quota rimborsabile può essere impiegata esclusivamente per il pagamento del contributo straordinario previsto dall?"articolo 1, commi da 68 a 73, della legge di bilancio 2026, secondo le regole generali sulla compensazione.Sono utilizzabili in compensazione anche gli interessi calcolati sulla quota IRAP a partire dalla data di versamento del saldo e fino alla data di presentazione del Modello.
