GRUPPO IVA: L?"AUTONOMA SOGGETTIVITà BLOCCA LA COMPENSAZIONE DEL CREDITO


Stop alla compensazione interna: il credito IVA del Gruppo si usa solo via rimborso o cessione. Con Risposta n. 88 del 30 marzo l'Agenzia delle Entrate è intervenuta sul tema dell?"utilizzo dell?"eccedenza a credito IVA maturata da un Gruppo IVA, chiarendo i limiti alla compensazione e le modalità alternative di utilizzo. L?"istanza è presentata dalla società rappresentante di un Gruppo IVA operativo dal 1° gennaio 2023, che evidenzia la formazione, nel corso del 2025, di un rilevante credito IVA (stimato in oltre 3 milioni di euro), derivante principalmente da ingenti investimenti ed un significativo volume di operazioni non imponibili.In tale contesto, l'istante chiede come poter utilizzare l'eccedenza a credito derivante dalla dichiarazione annuale IVA 2026 (anno d'imposta 2025) del Gruppo IVA, in aggiunta o in alternativa alla richiesta di rimborso, che sarebbe limitata al solo importo dell'IVA a credito assolta sugli investimenti. La posizione dell?"Agenzia delle EntrateNel parere fornito l'Amministrazione finanziaria, richiamando la disciplina del Gruppo IVA (artt. 70-bis e ss. del DPR n. 633/1972 e D.M. 6 aprile 2018), ribadisce che l?"autonoma soggettività passiva del medesimo impedisce la compensazione con debiti e crediti facenti capo a soggetti diversi, anche se partecipanti al Gruppo e ancorché titolari del ruolo di rappresentante.Conseguentemente, il credito IVA del Gruppo può essere utilizzato esclusivamente a rimborso, in presenza dei presupposti di cui all'articolo 30 del decreto IVA, oppure ceduto a terzi.
