ANTIRICICLAGGIO: SONO UNA PERSONA POLITICAMENTE ESPOSTA, PERCHé?


Mi hanno nominato a presiedere il collegio sindacale di una società formata da soli Comuni della Provincia di Cuneo, quella che gli esterofili chiamano “in house” e mi sono ritrovato ad essere, per l?"antiriciclaggio, una persona politicamente esposta. Il problema è che il legislatore all?"articolo 1 paragafo dd) punto 1.7 del Dlgs. 231/2007 ha indicato che è una persona politicamente esposta il "componente degli organi di amministrazione, direzione o controllo delle imprese controllate, anche indirettamente, dallo Stato italiano o da uno Stato estero ovvero partecipate, in misura prevalente o totalitaria, dalle Regioni, da comuni capoluoghi di provincia e città metropolitane e da comuni con popolazione complessivamente non inferiore a 15.000 abitanti". Mi è venuto da chiedere perché i componenti degli organi di controllo, che al contempo debbono garantire il requisito di indipendenza siano persone politicamente esposte, oppure il legislatore ha inteso sottolineare che la nomina in tali società, essendo effettuata da un soggetto pubblico è una nomina politica, al di là del requisito di indipedenza, dei requisiti di competenza e professionalità etc.?

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
