ETS NON COMMERCIALI: COME FUNZIONA LA TASSAZIONE DELLA RACCOLTA FONDI


Nella Circolare n. 1/2026 del 19 febbraio, dedicata alle disposizioni del Codice del Terzo settore in materia di imposte sui redditi e alla qualificazione fiscale degli enti iscritti nel Registro unico nazionale del Terzo settore (RUNTS), l?"Agenzia delle Entrate ha fornito importanti chiarimenti sulla disciplina tributaria delle attività di raccolta fondi svolte dagli ETS di natura non commerciale. Per raccolta fondi si intende il complesso delle attività e iniziative poste in essere da un ente del Terzo settore per finanziare le proprie attività di interesse generale, anche attraverso la richiesta a terzi di lasciti, donazioni e contributi di natura non corrispettiva.Tali attività possono essere realizzate anche in forma organizzata e continuativa, mediante sollecitazione al pubblico oppure attraverso la cessione o l?"erogazione di beni e servizi di modico valore. In questo ambito, gli enti possono avvalersi sia di risorse proprie sia di soggetti terzi, inclusi volontari e dipendenti, nel rispetto dei principi di verità, trasparenza e correttezza nei rapporti con i sostenitori e il pubblico, in conformità alle linee guida adottate con decreto del Ministro del Lavoro e delle Politiche sociali del 9 giugno 2022, in attuazione dell?"articolo 7 del Codice del Terzo settore. Sotto il profilo fiscale, l?"articolo 79, comma 4, lettera a), del Codice del Terzo Settore (Dlgs n. 117/2017) prevede che "Non concorrono, in ogni caso, alla formazione del reddito degli enti del Terzo settore di natura non commerciale i fondi pervenuti a seguito di raccolte pubbliche effettuate occasionalmente anche mediante offerte di beni di modico valore o di servizi ai sovventori, in concomitanza di celebrazioni, ricorrenze o campagne di sensibilizzazione".Diversamente, qualora l?"ETS assuma la qualifica di ente commerciale, le stesse entrate da raccolte fondi saranno assoggettate a tassazione quali redditi d?"impresa.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
