ANTIRICICLAGGIO: NUOVE REGOLE PER L?"ACCESSO AI DATI SULLA TITOLARITà EFFETTIVA


Il Consiglio dei Ministri, nella seduta n. 164 del 10 marzo, ha approvato in esame preliminare un decreto legislativo che recepisce alcune disposizioni della direttiva (UE) 2024/1640 in materia di prevenzione del riciclaggio e del finanziamento del terrorismo. Accesso alle informazioni sulla titolarità effettivaIl provvedimento interviene in particolare sulla disciplina dell?"accesso alle informazioni sulla titolarità effettiva contenute nel Registro delle imprese, con l?"obiettivo di rafforzare la trasparenza sugli assetti proprietari e di controllo di società, enti giuridici e trust. I nuovi articoli da 21-bis a 21-septies definiscono in modo organico le modalità di consultazione dei dati. Accesso per autorità competenti e soggetti obbligatiL?"accesso è garantito alle autorità competenti tramite sistemi telematici dedicati e ai soggetti obbligati ai fini antiriciclaggio, limitatamente alle attività di adeguata verifica della clientela, previa registrazione presso la Camera di commercio e pagamento dei diritti di segreteria. I soggetti obbligati potranno inoltre segnalare eventuali incongruenze nelle informazioni relative alla titolarità effettiva. Il decreto introduce anche una disciplina specifica per l?"accesso da parte di soggetti portatori di un legittimo interesse, tra cui giornalisti, enti del Terzo settore, università e ricercatori, nonché soggetti che intendano instaurare rapporti economici con un?"impresa. In questi casi la verifica dell?"interesse è affidata alle Camere di commercio, che rilasciano, se sussistono i requisiti, un certificato di accesso con validità triennale. Tutela dei titolari effettivi e limiti alla consultazioneIl Decreto prevede infine misure di tutela per i titolari effettivi, con la possibilità di limitare o escludere l?"accesso ai dati in presenza di particolari situazioni di rischio, come minacce alla sicurezza personale o condizioni di vulnerabilità. Il provvedimento modifica inoltre il regolamento del MEF n. 55/2022, eliminando il riferimento all?"accesso generalizzato del pubblico e limitando la consultazione ai soggetti autorizzati o titolari di un interesse qualificato.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
