CREDITO IRAP ENTI PUBBLICI: COMPENSAZIONE VERTICALE SOLO IN DICHIARAZIONE, SENZA F24EP


L?"Agenzia delle Entrate conferma che il credito IRAP degli enti pubblici può essere utilizzato in compensazione verticale esclusivamente all?"interno della dichiarazione, senza passare dal modello F24EP. Il chiarimento arriva dall'Agenzia delle Entrate (Risposta n. 62 del 3 marzo), intervenuta sul corretto utilizzo del credito IRAP maturato dagli enti pubblici, con un?"indicazione operativa rilevante per amministrazioni ed enti istituzionali. Il caso riguarda un ente pubblico che, dalla dichiarazione IRAP 2024 (anno d?"imposta 2023), ha evidenziato un credito superiore a 6,6 milioni di euro, regolarmente indicato in dichiarazione (quadro IR32) e munito di visto di conformità. Il Collegio sindacale aveva espresso dubbi sulla possibilità di utilizzare tale credito in compensazione verticale del debito IRAP dello stesso tributo, considerato che il modello F24EP non prevede un codice tributo a credito per l?"IRAP enti pubblici e non consente la presentazione di un modello “a saldo zero”.L?"istante ha quindi chiesto se fosse corretto procedere con una compensazione “interna”, senza trasmissione di F24EP, limitandosi a evidenziare l?"utilizzo del credito nella dichiarazione successiva. Nel parere fornito l?"Agenzia delle Entrate, pur richiamando le regole generali sulle compensazioni e i nuovi obblighi telematici per i modelli F24, ha chiarito che nel caso dell?"IRAP enti pubblici la compensazione verticale non va esposta in F24.Viene quindi confermata la soluzione dell?"ente: il credito può essere utilizzato esclusivamente tramite compensazione “interna” in dichiarazione. Si tratta di un regime peculiare, in cui la dichiarazione rappresenta l?"unico strumento di gestione del credito, senza necessità di F24EP né di codici tributo dedicati.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
