RATING LEGALITà: DAL 16 MARZO 2026 IN VIGORE IL NUOVO REGOLAMENTO


Con delibera dell?"Autorità Garante della Concorrenza e del Mercato del 27 gennaio 2026 è stato approvato il nuovo Regolamento attuativo in materia di rating di legalità (adottato ai sensi dell?"art. 5-ter del decreto legge 24 gennaio 2012, n. 1, così come modificato dall?"art. 1, comma 1-quinquies, del decreto-legge 24 marzo 2012, n. 29, convertito, con modificazioni, dalla legge 18 maggio 2012, n. 62). Il nuovo Regolamento entra in vigore dal 16 marzo 2026. Questi i principali elementi di novità: il rating attribuito o rinnovato con il nuovo Regolamento avrà una durata di tre anni; verrà riconosciuto un punteggio aggiuntivo all?"impresa che, alla presentazione della domanda di rinnovo, risulti averlo già ottenuto, in via continuativa, per almeno tre volte precedenti; l?"attestato di attribuzione del rating verrà rilasciato anche in lingua inglese, così da rendere l?"attestazione più spendibile anche sui mercati esteri. A fronte della maggiore durata del rating di legalità e per la sua natura premiale, sono stati rafforzati i presidi di legalità – con riferimento ai motivi di carattere penale, prefettizio o giudiziario – e sono state inasprite le conseguenze in caso di violazione degli obblighi informativi. Dal 16 marzo le imprese dovranno utilizzare i nuovi Formulari e Modelli che saranno resi disponibili sulla piattaforma WebRating e sul sito dell?"Autorità – sezione Rating di legalità. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
