SCISSIONE E STP: NIENTE RITENUTA D?"ACCONTO SUI COMPENSI INCASSATI DOPO L?"OPERAZIONE


Con la Risposta n. 21 del 28 gennaio l?"Agenzia delle Entrate ha fornito importanti chiarimenti sul trattamento fiscale dei compensi professionali incassati da una società tra professionisti (STP) a seguito della scissione totale di un?"associazione professionale. Il caso riguarda compensi relativi a prestazioni rese e fatturate dall?"associazione prima della scissione, ma incassati successivamente dalla STP, subentrata nei crediti per effetto dell?"operazione straordinaria.  Secondo l?"Agenzia, tali somme producono reddito d?"impresa e non reddito di lavoro autonomo, in quanto percepite da un soggetto che opera in forma societaria. Di conseguenza, non si applica la ritenuta d?"acconto prevista dall?"articolo 25 del DPR n. 600/1973, anche se le prestazioni sono state originariamente svolte dall?"Associazione professionale.  I clienti, una volta informati della scissione, dovranno quindi corrispondere alla STP i compensi fatturati dall'Associazione per l'intero importo al lordo della ritenuta.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
