CARTELLA DI PAGAMENTO E OBBLIGO DI MOTIVAZIONE: CHIARIMENTI DELLA CASSAZIONE


Con l?"ordinanza n. 235, pubblicata il 5 gennaio 2026, la Corte di Cassazione, Sezione V civile, torna a pronunciarsi sul tema dell?"obbligo di motivazione della cartella di pagamento, chiarendo quando esso possa ritenersi assolto mediante il semplice richiamo alle dichiarazioni del contribuente. Nel provvedimento, la Suprema Corte ha affermato il seguente principio di diritto: "In tema di riscossione delle imposte, sebbene in via generale la cartella esattoriale, che non segua uno specifico atto impositivo già notificato al contribuente, ma costituisca il primo ed unico atto con il quale l'ente impositore esercita la pretesa tributaria, debba essere motivata alla stregua di un atto propriamente impositivo, tale obbligo di motivazione deve essere differenziato a seconda del contenuto prescritto per ciascuno tipo di atto, sicché, nel caso in cui la cartella di pagamento sia stata emessa in seguito a liquidazione effettuata in base alle dichiarazioni rese dal contribuente ai sensi degli artt. 36 bis del d.P.R. n. 600 del 1973 e 54 bis del d.P.R. n. 633 del 1972, l'obbligo di motivazione può essere assolto mediante il mero richiamo a tali dichiarazioni perché, essendo il contribuente già a conoscenza delle medesime, non è necessario che siano indicati i presupposti di fatto e le ragioni giuridiche della pretesa". La pronuncia riafferma la distinzione tra cartelle che costituiscono il primo atto impositivo e quelle emesse all?"esito di controlli automatizzati o formali, per le quali l?"onere motivazionale risulta attenuato in ragione della conoscibilità degli elementi posti a base della pretesa tributaria.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
