Pagamento di fatture a professionisti a fine anno: spariti tutti i dubbi


Il pagamento di fatture nei confronti di professionisti a fine anno era fonte di incertezze, tant’è che negli anni precedenti avevo occasione di scrivere quanto riportato in coda. Ora l’articolo 54  del Tuir (sostituito dall’art. 5 dal D.lgs. 192/2024 con effetto dal 2024) introduce una nuova regola per i compensi pagati “a cavallo d’anno” da soggetti tenuti ad effettuare la ritenuta di acconto: il professionista deve dichiarare il compenso nell’anno in cui sussiste per il cliente l’obbligo di effettuare la ritenuta di acconto: quindi il cliente effettua il pagamento il 31 dicemb5e 2025 e versa la ritenuta entro il 16 gennaio 2026 ed il professionista dichiara il compenso nell’anno 2025 e nello stesso anno scomputa la ritenuta di acconto.  Questi i dubbi sino all’emanazione del D.lgs. 192/2024Sono andato a ricercarmi il contenuto di un processo verbale un po’ datato (2005) per rivedere cosa scrivevano i militari della Guardia di Finanza relativamente ai pagamenti effettuati con bonifico bancario. Nel caso di pagamento con bonifico bancario di parcelle a professionisti disposto il 31 dicembre le conseguenze sarebbero, ad avviso del sottoscritto, le seguenti:  la ditta che dispone il pagamento il 31 dicembre 2023  rileva il pagamento nella stessa data; la ditta che dispone il pagamento il 31 dicembre 2023 versa la ritenuta di acconto il 16 gennaio 2024; il professionista riceve il pagamento “ha conoscenza dell’accredito” con ogni probabilità il 2 gennaio 2024 . Per la ditta quindi il pagamento è avvenuto nel 2023 e certifica il compenso come corrisposto nel 2023, per il professionista il pagamento è avvenuto nel 2024 e dichiara il compenso, con applicazione del criterio di “cassa”, nel 2024 e si trova in possesso di una certificazione di ritenuta di acconto 2023 per compensi che dichiara nel 2024: bel pasticcio, considerando che all’Agenzia delle Entrate risulterà un errato incrocio dei dati tra certificazione rilasciata dalla ditta e dichiarazione presentata dal professionista ed occorrerà “correre” per spiegare il tutto. Per questo motivo sconsigliamo vivamente di effettuare pagamenti a mezzo bonifico bancario nei confronti di professionisti negli ultimi due-tre giorni dell’anno,  meglio effettuare tali pagamenti almeno quattro o cinque giorni prima, non sono certo gli interessi di pochi giorni a giustificare le complicazioni ed i conseguenti costi  che potrebbero derivare dai pagamenti effettuati a ridosso del 31 dicembre.
