SUPERBONUS: ERRORE NELLA COMUNICAZIONE DELL?"OPZIONE? L?"AGENZIA ENTRATE CONFERMA L?"IMMODIFICABILITà DOPO IL 16 MARZO


Con Risposta n. 295 del 24 novembre l'Agenzia delle Entrate si è espressa in tema di Superbonus ed, in particolare, sull'immodificabilità opzione cessione del credito/sconto in fattura, ex articolo 121 d.l. n. 34 del 2020 (Decreto Rilancio), chiarendo che, nel caso in cui la comunicazione dell?"opzione dello sconto in fattura sia stata compilata in modo errato e non corretta entro i termini di legge, non è più possibile modificare l?"opzione esercitata, anche se l?"errore è materiale e anche se nella realtà dei rapporti contrattuali le parti avevano inteso applicare lo sconto in fattura. L?"Agenzia ricorda che l?"errore può essere rettificato solo entro il 16 marzo dell?"anno successivo a quello di sostenimento della spesa, tramite l?"invio di una nuova comunicazione, mentre la possibilità di avvalersi oltre tale termine della remissione in bonis, oggi espressamente preclusa dall?"articolo 2 del d.l. 39/2024, è venuta meno. In ogni caso, la correzione è ammessa soltanto quando l?"opzione esercitata resta valida e non sia già intervenuta l?"accettazione del credito derivante da una comunicazione non corretta. Nel caso concreto, rileva l?"Agenzia, il credito relativo alle fatture 2023 è già stato accettato e in parte compensato; di conseguenza, non è più possibile rimediare all?"errore né considerare valida l?"opzione per lo sconto in fattura che le parti avevano inteso applicare.Resta comunque ferma la validità della rinuncia alla detrazione espressa dai condomini: la società, in qualità di cessionaria, potrà utilizzare il credito in compensazione oppure cederlo esclusivamente ai soggetti qualificati (banche, intermediari finanziari o imprese di assicurazione), ma non potrà beneficiare degli effetti tipici dello sconto in fattura, né cedere il credito a soggetti non qualificati.
