SUPERBONUS: PLUSVALENZA TASSATA SE L?"IMMOBILE VIENE VENDUTO ENTRO 10 ANNI DALLA FINE DEI LAVORI


Se un immobile oggetto di interventi ammessi al Superbonus viene ceduto a titolo oneroso prima che siano trascorsi dieci anni dalla conclusione degli stessi, la plusvalenza che ne deriva è, in linea di principio, imponibile, tranne nell'ipotesi in cui il cedente abbia acquisito l'immobile «per successione» oppure qualora l'immobile sia stato adibito ad abitazione principale (propria o di un suo familiare) per il periodo minimo indicato dalla norma. Diversamente, se l'immobile che si intende cedere non è stato acquisito per successione, ma per donazione, e non è stato adibito ad abitazione principale, non opera l'esclusione dall'imposizione prevista dalla norma. In tal caso, quindi, qualora si ceda a titolo oneroso un immobile prima che siano decorsi dieci anni dalla conclusione degli interventi ammessi al Superbonus, genera una plusvalenza imponibile ai sensi dell?"articolo 67, comma 1, lettera b-bis) del TUIR, da determinare secondo le modalità indicate dall?"articolo 68 del medesimo testo unico. Il chiarimento è contenuto nella Risoluzione n. 62 del 30 ottobre dell'Agenzia delle Entrate.L'Agenzia ricorda inoltre che, come già chiarito con la Circolare n. 13/E del 13 giugno 2024, la tassazione riguarda la prima cessione d'immobili che sono stati interessati dagli interventi ammessi al Superbonus, a prescindere dal soggetto che ha eseguito gli interventi, dalla percentuale di detrazione spettante, dalla modalità di fruizione di quest'ultima e dalla tipologia d'intervento effettuato.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
