DOMANDE DI CAMBIO NOME E COGNOME: SI PAGA IL BOLLO ANCHE ALL?"ESTERO


L'Agenzia delle Entrate ha risposto ad un'istanza di interpello dove veniva chiesto di conoscere se, in applicazione delle disposizioni del D.Lgs. n. 139.2024, che prevedono che dal 1°gennaio 2025 gli atti adottati o ricevuti dagli uffici diplomatici e consolari non siano soggetti all'imposta di bollo, anche le istanze di cambio nome e cognome e gli atti ad esse conseguenti fossero esenti dalla citata imposta.Veniva inoltre chiesto di conoscere se i cittadini residenti all?"estero potessero utilizzare il servizio @e.bollo per il pagamento. Nella Risposta n. 267 del 22 ottobre le Entrate hanno chiarito che l'istanza di modifica del nome o del cognome, rientrando tra quelle tendenti a ottenere un provvedimento amministrativo, è soggetta al pagamento dell'imposta di bollo fin dall'origine, come stabilito dell'articolo 3 della Tariffa allegata al DPR n. 642/1972.Ciò vale anche quando la domanda è presentata agli uffici diplomatici e consolari, che in questo caso agiscono solo come tramite per trasmettere la richiesta al Prefetto, autorità competente all?"adozione del provvedimento. Anche gli atti conseguenti, a loro volta, saranno anch'essi assoggettati all'imposta di bollo ai sensi dell'articolo 4 della stessa Tariffa.Unica eccezione quando il cambiamento di nome o cognome è richiesto perché ridicolo, vergognoso o rivelante origine naturale, come previsto dall?"articolo 93 del DPR n. 396/2000. IN questo caso nessuna imposta di bollo è dovuta. Con riferimento al secondo quesito relativo al pagamento dell'imposta all'estero l'Agenzia ricorda che sul proprio sito internet è disponibile una sezione dedicata alle modalità di versamento delle imposte dall?"estero.In particolare, i contribuenti non residenti in Italia e non titolari di conti correnti presso banche convenzionate con l'Agenzia delle Entrate, possono eseguire dall'estero il versamento delle imposte dovute tramite bonifico bancario in euro in favore del bilancio dello Stato oppure dei conti di tesoreria, secondo le istruzioni indicate online.
