CONTRATTI DI ARRUOLAMENTO SU UNITà DA DIPORTO COMMERCIALI: ESONERO DALL?"OBBLIGO DI REGISTRAZIONE


I contratti di arruolamento dei marittimi imbarcati su unità da diporto impiegate commercialmente sono esonerati dall?"obbligo di registrazione, al pari di quelli relativi alle navi mercantili e da pesca. Con la Risposta n. 268 del 22 ottobre, l?"Agenzia delle Entrate, dopo aver acquisito il parere del Ministero dei Trasporti, ha precisato che i contratti di arruolamento dei marittimi a bordo di unità da diporto utilizzate per fini commerciali possono essere assimilati a quelli stipulati per le unità mercantili. Di conseguenza, anche a tali contratti si applica l?"esonero dall?"obbligo di registrazione, già previsto per i contratti di arruolamento del personale imbarcato su navi da pesca e navi mercantili, in base alla semplificazione introdotta dall?"articolo 2, comma 2, del Dlgs n. 139/2024. Quest?"ultimo stabilisce infatti che “per i contratti di arruolamento esenti dalle imposte di bollo e di registro ai sensi dell?"art. 2-undecies, comma 2, del decreto-legge 30 settembre 1994, n. 564, convertito, con modificazioni, dalla legge 30 novembre 1994, n. 656, non vi è l?"obbligo di chiedere la registrazione”. L?"istanza di interpello era stata presentata per verificare se, dopo l?"entrata in vigore del Dlgs n. 139/2024, fosse ancora valida l?"assimilazione già riconosciuta in precedenza dal Ministero delle Infrastrutture e dei Trasporti, che aveva equiparato le unità da diporto impiegate commercialmente alle unità mercantili in materia di arruolamento dei marittimi.L?"Agenzia conferma che tale equiparazione rimane pienamente valida, comportando quindi la cessazione dell?"obbligo di registrazione per le convenzioni di arruolamento dei marittimi imbarcati su unità da diporto impiegate commercialmente (ad esempio commercial vessels, charter, ecc.).   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
