Sanzioni sulla registrazione tardiva dei contratti di locazione: l'Agenzia delle Entrate si allinea alla Cassazione


L'Agenzia delle Entrate ha recentemente adottato un nuovo orientamento riguardo il calcolo delle sanzioni per la registrazione tardiva dei contratti di locazione di immobili urbani di durata pluriennale. Con la risoluzione n. 56/2025, l'Agenzia supera la sua precedente indicazione (contenuta nella circolare n. 26/2011) e si allinea alla giurisprudenza della Cassazione.Il nuovo criterio di calcoloIn caso di registrazione tardiva di un contratto di locazione o sublocazione di durata pluriennale, soggetto all'imposta di registro, la sanzione prevista dall'articolo 69 del D.P.R. 131/86 deve essere calcolata prendendo come riferimento l'imposta di registro dovuta sulla prima annualità del canone, a condizione che il contribuente abbia scelto il pagamento annuale dell'imposta.Questo criterio si applica quando il contribuente si è avvalso della facoltà di pagamento rateizzato dell'imposta, come previsto dall'articolo 17, comma 3, del D.P.R. 131/86. La sanzione in dettaglioLe sanzioni per omessa o tardiva registrazione sono disciplinate dall'articolo 69 del D.P.R. 131/86. omessa registrazione: la sanzione è pari al 120% dell'imposta dovuta, con un minimo di 250 euro. ritardo non superiore a 30 giorni: si applica la sanzione amministrativa del 45% dell'ammontare delle imposte dovute, con un minimo di 150 euro. Per le annualità successive alla prima, in caso di mancato versamento, si applicherà la sanzione per tardivo versamento di cui all'articolo 13 del D.Lgs. 471/97. Resta sempre possibile accedere al ravvedimento operoso in presenza dei presupposti. Contratti con cedolare seccaNel caso di tardiva registrazione di un contratto di locazione per il quale è stata optata la cedolare secca, l'Amministrazione conferma che resta dovuta solo la sanzione fissa prevista dall'articolo 69, pari a 150 euro.
