PEC amministratori: qualche legittimo dubbio sulla privacy


L’obbligo di comunicare la PEC personale al Registro delle Imprese solleva interrogativi sulla tutela della privacy degli amministratori, specie quando si utilizza l’indirizzo della società.Com’è noto entro il 31 dicembre 2025 (termine originario “contestato” il 30.06.2025) sussiste l’obbligo, peraltro non sanzionato, per gli amministratori di società costituite ante 1.1.2025 (incluse quelle di persone) di comunicare al Registro delle Imprese il proprio indirizzo PEC personale, mediante una pratica Comunica, esente da bolli e diritti; per le società costituite dall’1.1.2025 l’obbligo viene assolto in sede di iscrizione della società al Registro Imprese. Come confermato tra l’altro dalla Camera di Commercio della Romagna “Tuttavia, non essendo attualmente previsto dalla norma un espresso divieto, l'Ufficio del registro delle imprese non disporrà il rifiuto della pratica, qualora venga indicato un indirizzo PEC di immediata disponibilità dell’interessato, compreso il domicilio digitale della società amministrata.”: ergo per l’amministratore Mario ROSSI si presenta la pratica dove viene indicato l’indirizzo ‘PEC della società, ipotesi la ALFABETA s.r.l. Fin qui tutto semplice e chiaro, nella visura della ALFABETA s.r.l. risulterà l’indirizzo ‘PEC  della società, alfabeta@pec.it, e nella stessa visura nei dati relativi all’amministratore Mario ROSSI risulterà l’indirizzo ‘PEC alfabeta@pec.it.: in pratica la società e l’amministratore avranno il medesimo indirizzo ‘PEC.  Il problema nasce alla ricezione di un messaggio PEC all’indirizzo alfabeta@pec.it :  è della società o di Mario ROSSI?  Se è di Mario ROSSI questi ha autorizzato per iscritto il personale di ALFABETA s.r.l. ad aprire i messaggi a lui destinati che potenzialmente potrebbero contenere dati “riservati” o anche “dati sensibili”?Meglio quindi, ad evitare qualsiasi complicazione, che Mario ROSSI si procuri un indirizzo PEC “personale”.

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
