Parte 3 - Il sistema premiale ISA: tutti i vantaggi per i contribuenti 'affidabili'


Uno degli aspetti più qualificanti degli Indici Sintetici di Affidabilità Fiscale è l'introduzione di un sistema premiale strutturato, pensato per ricompensare i contribuenti "virtuosi".L'obiettivo è chiaro: incentivare l'adempimento spontaneo attraverso benefici concreti che riducono gli oneri burocratici e i rischi di accertamento. I criteri di accesso a questi vantaggi sono definiti annualmente con provvedimenti del Direttore dell'Agenzia delle Entrate e si basano su una duplice logica: valutare l'affidabilità fiscale nel singolo periodo d'imposta premiare la costanza, analizzando la media dei punteggi ottenuti nel periodo corrente e in quello precedente. Di seguito si riporta la tabella riassuntiva dei principali benefici, con i relativi punteggi di accesso riferiti ai periodi d'imposta 2023 e 2024. BENEFICI PREMIALI PUNTEGGIO (periodo d'imposta di applicazione) MEDIA PUNTEGGI (periodo d'imposta di applicazione e precedente) Esonero dal visto di conformità per compensazione crediti: - IVA fino a 50.000 €/anno - Imposte dirette/IRAP fino a 20.000 €/anno 8 8,5 Esonero dal visto di conformità per compensazione crediti: - IVA fino a 70.000 €/anno - Imposte dirette/IRAP fino a 50.000 €/anno 9 9 Esonero dal visto di conformità o dalla garanzia per rimborsi IVA: - Fino a 50.000 €/anno 8 8,5 Esonero dal visto di conformità o dalla garanzia per rimborsi IVA: - Fino a 70.000 €/anno 9 9 Esclusione dall'applicazione della disciplina delle società non operative 9 9 Esclusione degli accertamenti basati su presunzioni semplici (c.d. analitico-presuntivi) 8,5 9 Anticipazione di un anno dei termini di decadenza per l'attività di accertamento 8 N/A Esclusione dalla determinazione sintetica del reddito complessivo (a condizione che il reddito accertabile non ecceda di 2/3 quello dichiarato) 9 9 Un ulteriore vantaggio per l'affidabilità pluriennale Oltre a quanto riportato in tabella, è previsto un beneficio specifico per chi dimostra un'affidabilità fiscale consolidata nel tempo. La legge n. 130/2022 ha infatti stabilito che i contribuenti con un punteggio ISA pari almeno a 9 per i tre periodi d'imposta precedenti a quello di proposizione di un ricorso tributario, sono esclusi dalla prestazione della garanzia richiesta per la sospensione dell'atto impugnato. Questo rappresenta un notevole vantaggio in caso di contenzioso, riducendo gli oneri finanziari a carico dell'impresa o del professionista. Il riferimento normativo è l'articolo 2 della legge n. 130/2022, che interviene sull'articolo 47 del D.Lgs. n. 546/1992. Questi benefici rendono evidente come il punteggio ISA non sia un mero "voto" fine a se stesso, ma una chiave d'accesso a un regime di maggiore serenità e operatività nel rapporto con l'Amministrazione finanziaria.
