Acquisto prima casa: il credito di imposta è personale, non vale per la parte ereditata


Risposta a quesito n.238/2025.Chi compra la prima casa detrae dall’imposta (IVA o registro) quella pagata per la prima casa precedente (art. 7 L 448/1998), ma pagata da lui, non dal coniuge, anche se poi ne ha ereditato la quota, e nemmeno dal figlio, anche se è fiscalmente a suo carico. Il credito infatti è personale, e, come già previsto dalla circolare 19/2001, “qualora l’immobile Alienato o quello acquisito risultino in comunione, il credito d'imposta deve essere imputato agli aventi diritto, rispettando la percentuale della comunione”, anche se poi tutti sono solidalmente obbligati a pagare (art. 57 TUIR). Essendo il nuovo acquisto soggetto a IVA, poi, l’Agenzia ricorda che va portato subito in detrazione dall’IRPEF, con la dichiarazione dei redditi che si presenta lo stesso anno, anche se relativa a quello precedente, se no si perde. E questo è obiettivamente un abuso, perché non è previsto dalla legge, anche se è sempre stato confermato da tutte le precedenti circolari (12/2016, 7/2021, 15/2023). L'agenzia respinge quindi la richiesta dell’istante, ma per il resto conferma le recenti “concessioni”: il credito spetta anche se si mantiene la proprietà della casa precedente purché si alieni entro il, nuovo, termine di due anni (comma 4-bis art. 1 nota 2-bis tariffa TUR), ed anche se l’acquisto precede la norma che, da quest’anno, ha allungato il termine di rivendita, che quindi sfora nel 2026. Un colpo al cerchio, e uno ... al contribuente.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
