RIORDINO DEL REGIME DI TASSAZIONE DEI REDDITI DEI TERRENI


Con la Circolare 12/E dell?"8 agosto 2025, l?"Agenzia Entrate ha fornito le istruzioni operative agli Uffici in materia di riordino del regime di tassazione dei redditi dei terreni, come disposto dal decreto legislativo n. 192/2024 pubblicato in attuazione della delega per la riforma fiscale (legge 111/2023). Tra le novità evidenziamo: Attività agricole tecnologiche e green – Sono quelle attività che, pur non essendo direttamente svolte mediante lo sfruttamento del terreno, hanno a oggetto la cura di un ciclo biologico o di una fase necessaria dello stesso, mediante le più moderne tecniche di coltivazione, realizzate in immobili accatastati, e delle attività che danno luogo alla cessione di beni, anche immateriali, derivanti dalle attività agricole, che concorrono alla tutela dell?"ambiente e alla lotta ai cambiamenti climatici. I redditi prodotti da tali attività saranno trattati come redditi agrari. Coltivazioni “fuori suolo” effettuate all?"interno di fabbricati accatastati – Anche le attività dirette alla produzione di vegetali realizzate mediante i più evoluti sistemi di coltivazione all?"interno di fabbricati accatastati (categorie C/1, C/2, C/3, C/6, C/7, D/1, D/7, D/8, D/9 e D/10) sono ora riconosciute come produttive di reddito agrario, a condizione che rispettino limiti legati alla superficie agraria di riferimento. Per effetto di tale intervento normativo sono ricondotte nel novero delle attività agricole produttive di reddito agrario le cosiddette “vertical farm”, le “colture idroponiche” e la “micropropagazione in vitro”. Cessione crediti di carbonio CO2 – I redditi prodotti dalle produzioni di beni, sia materiali sia immateriali, compresi quelli debitamente certificati, derivanti dalle attività agricole che impiegano modalità e tecniche virtuose sotto il profilo della tutela dell?"ambiente e della lotta ai cambiamenti climatici, si configurano come agrari. Si configurano come tali, entro certi limiti, anche quelli conseguiti per la cessione di crediti di carbonio ottenuti mediante la cattura di CO2, debitamente certificati.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
