CREDITO D?"IMPOSTA RICERCA E SVILUPPO: ATTO DI INDIRIZZO MEF SU DISTINZIONE TRA CREDITI INESISTENTI E NON SPETTANTI


Con l?"Atto di indirizzo del 1° luglio 2025 il Ministero dell?"Economia e delle Finanze ha fornito le coordinate interpretative per distinguere in modo certo tra “crediti d?"imposta inesistenti” e “crediti non spettanti”. Il documento introduce una più rigorosa distinzione normativa e sanzionatoria tra le fattispecie di: Crediti non spettanti (art. 1, comma 1, lett. g-quinquies): crediti formalmente esistenti ma utilizzati in violazione delle modalità previste, ad esempio per errori su importi, tempi o adempimenti; Crediti inesistenti (art. 1, comma 1, lett. g-quater): crediti privi dei presupposti oggettivi o soggettivi, o ottenuti tramite artifici o documentazione falsa. La tipologia di “non spettanza” si verifica quando, ferma restando la sussistenza dei requisiti oggettivi e soggettivi specificatamente individuati nella normativa di riferimento, il credito d?"imposta difetta di ulteriori elementi o qualità individuate da fonti tecniche di dettaglio non specificatamente richiamate nella normativa, primaria e secondaria, dell?"agevolazione (pur senza uno specifico richiamo è chiaro il riferimento al “manuale di Frascati”). Ricordiamo che: sotto il profilo sanzionatorio, per i crediti inesistenti, è prevista una sanzione del 70% (raddoppiata in caso di frode). Per i crediti non spettanti, si applicano sanzioni in base al tipo di violazione. i termini per gli atti di recupero sono entro il 31 dicembre del 5° anno per i crediti non spettanti ed entro il 31 dicembre dell?"8° anno per i crediti inesistenti (10 anni per i crediti d?"imposta utilizzati negli anni 2016 e 2017. Attenzione, si fa riferimento alla compensazione e non alla maturazione. Per redimere eventuali contestazioni riferite alla fattispecie dei crediti “inesistenti”, l?"atto di indirizzo ricorda che il contribuente può dotarsi di una certificazione rilasciata da soggetti qualificati e ammessi a sottoscriverla, che attesti che le attività svolte rientrano tra quelle ammissibili, per fornire garanzia “ex ante” sulla spettanza del credito.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
