SFRATTO PER MOROSITà: CREDITO D?"IMPOSTA PER I CANONI NON RISCOSSI


Per le imposte versate sui canoni scaduti e non percepiti, accertati nell'ambito del procedimento giurisdizionale di convalida di sfratto per morosità, il contribuente, ai sensi dell'articolo 26 del TUIR, ha diritto a un credito d?"imposta pari alle imposte già versate su quei canoni mai incassati. Tale credito può essere indicato nella prima dichiarazione dei redditi utile successiva alla conclusione del procedimento giurisdizionale di convalida dello sfratto e comunque non oltre il termine ordinario di prescrizione decennale. Nel caso in cui il contribuente non intenda avvalersi del credito d?"imposta nell?"ambito della dichiarazione dei redditi, può presentare specifica istanza di rimborso, sempre entro i medesimi termini di prescrizione.
