Il contratto di locazione breve di immobile ad uso abitativo a scopo turistico


La locazione di immobili per brevi periodi a scopo turistico è una pratica sempre più diffusa. Per orientarsi tra le normative e gli adempimenti, è fondamentale che proprietari (locatori) e ospiti (conduttori) conoscano le regole che disciplinano questi contratti. Possiamo identificare tre diverse categorie di affitti: Locazione Breve: È una categoria definita ai fini fiscali. Si tratta di un contratto di affitto di un immobile abitativo di durata non superiore a 30 giorni, stipulato da persone fisiche al di fuori di un'attività d'impresa. La normativa di riferimento è l'art. 4 del D.L. n. 50/2017. Locazione Turistica: È una definizione più ampia, caratterizzata dalla finalità turistica del soggiorno. La sua durata può essere variabile (anche superiore a 30 giorni) ed è regolata principalmente dal Codice Civile e dalla Legge 431/98. Quando una locazione turistica ha una durata inferiore a 30 giorni, le sue regole si sovrappongono a quelle della locazione breve. Casa Vacanze: Si tratta di una struttura ricettiva extralberghiera gestita in forma imprenditoriale. Prevede l'affitto di immobili arredati e può offrire servizi aggiuntivi (come pulizie periodiche, transfer, ecc.), a differenza della semplice locazione.
