CESSIONI DPI E DISPOSITIVI MEDICI CON IVA AL 5% ANCHE SE FUORI DAL PERIODO EMERGENZIALE


Il progressivo abbandono dei protocolli di sicurezza Covid ha eliminato l'obbligo di utilizzare i dispositivi medici e di protezione da parte di soggetti diversi dal personale sanitario, anche se in molti settori si è continuato a utilizzarli su base volontaria. Nella Risposta n. 141 del 23 maggio l'Agenzia delle Entrate ha chiarito in merito alla possibilità, nonostante il superamento del periodo emergenziale, che le cessioni alle aziende della grande distribuzione che utilizzano i prodotti sia ai fini della protezione sanitaria dei propri dipendenti, sia per la vendita al pubblico e/o per i grossisti che normalmente rivendonotali prodotti ad aziende di tutti i settori merceologici che potrebbero utilizzarli tanto permotivi sanitari che operativi, continuino ad essere soggette all'aliquota Iva ridotta del5%. Se i beni ceduti sono dei DPI o dei dispositivi medici, compresi in una delle voci doganali individuate dall'ADM nell'allegato I della circolare 5/D del 2023, spiegano le Entrate, continua ad appicarsi l'aliquota IVA del 5% in ogni fase della loro commercializzazione, dal produttore fino alla vendita al dettaglio, dato che il requisito dell'uso per finalità sanitarie può ritenersi soddisfatto ogniqualvolta "non emerga in modo chiaro e univoco prova del contrario".   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
