LA RIFORMA DELLE ACCISE IN GAZZETTA UFFICIALE: NASCE IL SOGGETTO OBBLIGATO ACCREDITATO (SOAC)


E' stato pubblicato, nella Gazzetta Ufficiale n. 79 del 4 aprile, il Decreto legislativo n. 43 del 28 marzo 2025, di revisione delle disposizioni in materia di accise.Il decreto, che rappresenta un ulteriore importante tassello per la riforma tributaria prevista dalla Delega fiscale, razionalizza la disciplina, semplifica gli adempimenti a carico degli operatori, ed introduce nuove forme premiali in favore dei contribuenti “affidabili”. Tra le novità da segnalare l'introduzione del soggetto obbligato accreditato (SOAC), ossia il soggetto obbligato al pagamento dell'accisa che, sulla base di una valutazione dell?"Agenzia delle Dogane e dei Monopoli (Adm), dimostra un elevato livello di affidabilità fiscale rispetto alle accise.L'istanza per l'attribuzione della qualifica di SOAC, di validità quadriennale, è presentata all'Agenzia delle dogane e dei monopoli, che verifica il possesso, da parte del soggetto, dei requisiti di ammissione richiesti. A seguito della valutazione dei profili di affidabilità, l'Agenzia delle dogane e dei monopoli attribuisce al soggetto un punteggio numerico sintetico, compreso tra 0 e 100; la qualifica di SOAC è riconosciuta solo se il punteggio attribuito è almeno pari a 60. Sulla base del punteggio ottenuto sono previsti tre livelli di affidabilità: base, medio e avanzato.  Una volta riconosciuto, il SOAC può avvalersi dell'esonero dagli obblighi di prestare cauzione e delle semplificazioni e facilitazioni degli adempimenti contabili e amministrativi individuate con decreto MEF.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
