INTERESSI DA RAVVEDIMENTO SPECIALE NON DEDUCIBILI: LA DISTINZIONE TRA NATURA RISARCITORIA E COMPENSATIVA


Con Risposta n. 56 del 3 marzo l'Agenzia delle Entrate fornisce chiarimenti in merito alla deducibilità degli interessi da ravvedimento versati da un professionista ai fini della determinazione del reddito di lavoro autonomo. Un professionista, avvalendosi dell'istituto del cd. Ravvedimento speciale, ha presentato nel 2024 delle dichiarazioni integrative relative a periodi d'imposta precedenti che hanno determinato l'indicazione di un maggiore debito d'imposta (IRPEF, addizionali all'IRPEF e IRAP). Successivamente, ha versato in un'unica soluzione nel 2024 le maggiori imposte dovute, l'importo della sanzione ridotta disposta dal ravvedimento speciale e gli interessi.Nella risposta fornita l'Agenzia Entrate chiarisce che i predetti interessi da ravvedimento speciale non sono deducibili dal reddito di lavoro autonomo ai sensi dell'articolo 54 del Tuir. Sono, invece, deducibili gli interessi passivi versati in esecuzione di atti di conciliazione e di accertamento con adesione, in quanto aventi una funzione "compensativa" del ritardo nell'esazione dei tributi differente rispetto a quella "risarcitoria" che contraddistingue gli interessi da ravvedimento.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
