CONTRATTI DI LAVORO E INCARICHI PROFESSIONALI SENZA IMPOSTA BOLLO, ANCHE SE RICONDUCIBILI AD APPALTI DI SERVIZI


Nella Risposta n. 40 del 20 febbraio l'Agenzia delle Entrate si occupa del caso di un Comune, non dotato di una propria avvocatura interna per la difesa in giudizio, che fruisce dei servizi legali offerti da professionisti esterni per promuovere azioni giudiziarie o di resistere in giudizio. A tal fine, è solito sottoscrivere con il professionista incaricato un disciplinare per il conferimento dell'incarico nel quale sono definiti in modo dettagliato doveri e prestazioni delle parti, e chiede quindi se tale disciplinare sia soggetto all'imposta di bollo o se sia invece applicabile l'esenzione di cui all'articolo 25 della Tabella, Allegato B, del D.P.R. n. 642/1972, che prevede l'esenzione in modo assoluto dall'imposta di bollo per i contratti di lavoro e d'impiego sia individuali che collettivi. Nel caso di specie, spiegano le Entrate, attese le modalità di conferimento dell'incarico al professionista così come dal disciplinare di affidamento dell'incarico allegato dall'istante, la fattispecie in esame è inquadrabile nell'ambito del contratto d'opera professionale.Tale contratto, dunque, rientrante tra i "Contratti di lavoro e d'impiego sia individuali che collettivi" di cui al citato articolo 25 della Tabella allegata al D.P.R. n. 642/1972, non sconta l'imposta di bollo.L'Agenzia Entrate evidenzia inoltre che, ove il contratto stipulato tra l'amministrazione e il professionista fosse riconducibile ad un appalto di servizi, non troverebbero comunque applicazione le disposizioni previste dal Codice dei contratti pubblici tra cui la disciplina da applicare per l'assolvimento dell'imposta di bollo.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
