La donazione con patto riversibilità per premorienza non preclude l'agevolazione prima casa


Risposta a interpello AE n. 27/2025.Per godere dell'agevolazione per l'acquisto della prima casa è ovviamente necessario non averne altre, o impegnarsi a cederle: occorre quindi "liberarsi" della proprietà di quella precedente.Se si vuole che la casa precedente resti nella propria disponibilità, o, comunque, in famiglia, la più fidata resta ... la mamma, disponibile alla restituzione, ove occorra. In caso di sua premorienza, però, l'immobile finirebbe in eredità anche agli altri suoi figli. Per evitarlo si può ricorrere in tal caso alla condizione di riversibilità (art. 791 c.c.) che, risolvendo gli effetti della donazione, fa tornare al donante la proprietà del bene, che non entra quindi nell'asse ereditario, avendo cura di precisare che la riversibilità opera solo per la premorienza della donataria, la mamma, e non anche dei suoi discendenti.Non ce n'era bisogno, ma qualcuno ha pensato di chiedere all'agenzia delle entrate se anche questo trasferimento, considerato "instabile" in quanto condizionato risolutivamente, potesse consentire al donante di chiedere l'agevolazione per la nuova prima casa; se cioè dopo la donazione potesse dovesse ritersi ugualmente soddisfatto "il requisito di non possidenza di altro immobile acquistato con l'agevolazione in parola, di cui alla citata lettera c) della Nota Il bis" del TUR.L'agenzia delle entrate, nella risposta ad interpello n. 27/2025, l'ha confermato senza esitazioni, perché la donazione "è immediatamente efficace, realizzando il trasferimento della titolarità dell'immobile alla madre donataria al momento della stipula dell'atto".Questa volta è andata bene, la roulette russa dell'interpello andrebbe però maneggiata con maggior prudenza...
