COOPERATIVE COMPLIANCE: ACCORDO AGENZIA ENTRATE E GDF PER LA COLLABORAZIONE E CONDIVISIONE DEI DATI


Siglato dall'Agenzia delle Entrate e dalla Guardia di Finanza un protocollo d'intesa con il quale le due Istituzioni si impegnano a regolare, coordinare e sviluppare la reciproca collaborazione nell?"ambito dell?"adempimento collaborativo (cooperative compliance).  Il regime di adempimento collaborativo è finalizzato a promuovere un rapporto di trasparenza e collaborazione tra l?"Amministrazione fiscale e i contribuenti. Si rivolge alle imprese che adottano un sistema strutturato di gestione e controllo del rischio fiscale, e prevede un dialogo continuo e preventivo per individuare e risolvere in anticipo le situazioni potenzialmente a rischio fiscale, aumentando così la trasparenza e la sicurezza del sistema tributario. Dal 2024 la platea dei soggetti ammessi al regime include anche i contribuenti con un volume d?"affari non inferiore a 750 milioni di euro. Tale soglia verrà ridotta progressivamente nei prossimi anni, passando a 500 milioni di euro nel 2026 e 100 milioni di euro nel 2028.Anche in vista del progressivo ampliamento della platea dei soggetti ammessi, dunque, Agenzia entrate e GdF sono chiamate a rafforzare la collaborazione, come previsto dal decreto legislativo n. 221/2023, attuativo della legge delega (Legge n. 111/2023). Al fine di assicurare un?"attività di compliance coerente con le finalità e le caratteristiche del regime è necessario che l?"Amministrazione finanziaria continui a garantire, in linea con le best practices internazionali, il modello organizzativo della c.d. Interfaccia Unica. Per fare questo l'Amministrazione finanziaria potrà avvalersi della collaborazione della Guardia di Finanza.Il protocollo, in particolare, prevede che la Guardia di Finanza segnali gli elementi identificativi di possibili fenomeni di evasione, elusione o frode fiscale o situazioni che possano comportare l?"esclusione dal regime e che l'Agenzia delle Entrate, a sua volta, comunichi alla Guardia di Finanza i dati identificativi dei soggetti che hanno chiesto di aderire, di quelli esclusi per perdita dei requisiti o per inosservanza degli impegni assunti e di coloro che, pur non possedendo i requisiti, hanno adottato un sistema di rilevazione, misurazione, gestione e controllo del rischio fiscale (tax control framework).   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
