ELENCO DEI COMMISSARI LIQUIDATORI - AL VIA LA REGISTRAZIONE ONLINE - DIRETTIVE DAL MINISTERO DELLO SVILUPPO ECONOMICO


Il Ministero dello Sviluppo Economico ha messo a disposizione dei professionisti interessati (avvocati, dottori commercialisti, ragionieri, consulenti del lavoro ed esperti in materia di lavoro e cooperazione) una piattaforma online per registrare la propria candidatura all'assunzione di incarichi di commissario liquidatore, commissario governativo e liquidatore di enti cooperativi. Con circolare del 4 aprile 2018 (pubblicata senza alcun protocollo) il Ministero dello Sviluppo Economico illustra le modalità di funzionamento del portale online relativo alla presentazione della domanda per l'iscrizione all'Elenco dei Commissari Liquidatori, Commissari Governativi e Liquidatori di Enti Cooperativi. Si tratta di una piattaforma che permette ai professionisti interessati di «registrare la propria candidatura compilando un semplice modulo online e grazie a questa semplificazione anche i tempi per la verifica delle dichiarazioni e per altre procedure interne all'Amministrazione saranno notevolmente ridotti». Il sistema richiede una preventiva iscrizione ed autenticazione, il possesso di un account PEC valido intestato al professionista e l'uso della firma digitale. In caso di esito positivo della procedura di registrazione, l'amministrazione prende atto della disponibilità manifestata dal professionista ad assumere gli incarichi evidenziati in premessa e conserva il nominativo nella relativa Banca dati, rendendolo disponibile per le operazioni di sorteggio e\o designazione successivamente descritte. Il Ministero rammenta che la disponibilità e le relative dichiarazioni devono essere aggiornate ogni anno, fermo l'obbligo di comunicare tempestivamente qualsiasi variazione dei dati oggetto di autocertificazione. Nel caso di mancato aggiornamento, allo scadere dell'anno dalla data di iscrizione, si prenderà atto della mancata volontà di permanere nella Banca dati. L'iscrizione viene disposta previa verifica della sussistenza dei prescritti requisiti e della assenza delle condizioni e cause di impedimento indicate nella circolare. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
