Il contenuto delle conversazioni tra il contribuente e il suo commercialista di fiducia può essere utilizzato per dimostrare il delitto tributario non operando il divieto dell'articolo 200 cpp. Le intercettazioni telefoniche|provano il reato tributario Il divieto di utilizzo delle intercettazioni - telefoniche e ambientali - previsto dal secondo comma dell'articolo 271 del codice di procedura penale - a tutela del segreto professionale - non opera nel caso in cui sia stato il commercialista a suggerire al cliente i modi per aggirare gli obblighi fiscali. Pertanto, il contenuto delle conversazioni intercorse tra il contribuente e il suo commercialista di fiducia può essere utilizzato per dimostrare il reato tributario.
