Il fatto di svolgere attività illecita non esonera dalla presentazione della dichiarazione dei redditi. Questo il principio esposto dalla Corte di Cassazione, Terza Sezione Penale, nella sentenza n. 53137 del 22 settembre 2017 con cui è stato ribadito che l'omessa presentazione della dichiarazione dei redditi costituisce violazione dell'art. 5, D.Lgs. n. 74 del 2000, "anche quando abbia ad oggetto redditi di provenienza illecita (tra le altre, Sez. 3, n. 42160 del 7/10/2010, Violi, Rv. 248729, a mente della quale integra il delitto in esame l'omessa dichiarazione dei redditi derivanti dall'attività di sfruttamento dell'altrui prostituzione, in quanto ogni provento, anche illecito, rappresenta reddito tassabile, la cui mancata indicazione nella dichiarazione annuale costituisce reato. In termini, anche Sez. 5, n. 7411 del 19/11/2009, Di Lorenzo, Rv. 246095, con riguardo a redditi provenienti da attività distrattiva compiuta su disponibilità finanziarie di società fallita)". The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
