TASSAZIONE INCENTIVI PER ATTIVITà SVOLTE IN PERIODI D'IMPOSTA PRECEDENTI A QUELLO DI EROGAZIONE


Con Risposta n. 227 del 25 novembre 2024 l'Agenzia delle Entrate chiarisce in merito all'applicabilità o meno del regime di tassazione separata, in luodo dell'ordinaria, agli incentivi corrisposti per attività svolte in periodi precedenti a quello dell'erogazione. Dopo un breve excursus sulla normativa di riferimento le Entrate hanno confermato la possibilità di applicazione del regime di tassazione separata alle retribuzioni aggiuntive corrisposte per le funzioni tecniche svolte, anche nel caso in cui siano corrisposte in un periodo d?"imposta successivo a quello di effettiva maturazione, a condizione che il ritardo sia dovuto al sopraggiungere di una causa giuridica, come, ad esempio, la stipula del contratto collettivo di lavoro.Nel caso in cui, invece, il ritardo nell'erogazione sia fisiologico rispetto ai tempi tecnici occorrenti per l'erogazione degli emolumenti stessi, essi concorrono alla formazione del reddito e sono quindi da assoggettare a tassazione ordinaria.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
