SCONTA LE IMPOSTE DI REGISTRO, IPOTECARIE E CATASTALI L'IMPIANTO FOTOVOLTAICO DI GRANDI DIMENSIONI


Gli impianti fotovoltaici di grande potenza, cosiddetti "parchi fotovoltaici", realizzati allo scopo di produrre energia da immettere nella rete elettrica nazionale per la vendita, ai fini delle imposte di registro, ipotecarie e catastali, devono essere considerati a tutti gli effetti come beni immobili, in quanto la connessione strutturale e funzionale tra il terreno e gli impianti è tale da poterli ritenere sostanzialmente inscindibili, a nulla rilevando che, astrattamente, gli stessi siano rimovibili ed installabili in altro luogo. A enunciare il principio di diritto la Corte di Cassazione, Sezione V Civile (Sentenza n. 6840 del 14 marzo 2024), che, sulla base dei criteri emersi in ambito dottrinale e giurisprudenziale in merito alla distinzione tra beni mobili e immobili, ritiene corretto classificare le centrali fotovoltaiche di grandi dimensioni, quale quella in esame, nella categoria dei beni immobili, in quanto l’eventuale precarietà dell’elemento materiale dell’ancoraggio al suolo è compensata da considerazioni attinenti al profilo strettamente funzionale.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
